A man from South Ozone Park was found guilty of numerous crimes, including attempted murder, attempted aggravated assault, and kidnapping, following his involvement in a noteworthy domestic violence incident that took place in September 2021.
On the day of the event, the victim, who serves with the NYPD, reported to her South Ozone Park residence around 6 in the morning. She found her then-spouse, the offender, awake, with noticeable red eyes, evidently amidst alcoholic consumption.
An argument arose between the two, during which the man began to damage various items within their home. As the victim attempted to soothe him, he retreated into her bedroom. Unknown to her at the time, it was in this room where her service and off-duty firearms were securely stored within a safe.
Emerging from the room, the husband faced his then-wife with guns in hand, uttering the words, ‘We are about to change the game up.’ He chillingly warned her that their lives would meet a violent end that day, and that any police intervention would only worsen the situation.
Regardless of the imminent threat, the victim decided to reach out for emergency assistance. Responding officers arrived swiftly, only to be met with a barricaded entrance to the residence.
The already escalated situation took another heated turn as the defendant unleashed a barrage of bullets. One of the shots managed to break through the glass door panel, nearly injuring an officer in uniform by striking his boot.
Another officer at the scene was able to communicate with the victim on the phone and urged her to escape from the house. She took a daring leap out of a second-story window as her husband advanced towards her, brandishing one of the firearms.
The brave leap for freedom came with a painful price. Upon landing on the concrete surface, she fractured her left knee. Alert to the situation, a nearby officer rushed in with a large ballistic blanket to shield her.
Rather than stop, the defendant then proceeded to the window from which his wife had jumped. He aimed his firearm at the officer protecting the victim with the blanket and discharged the weapon. Undeterred, he continued his barrage of gunfire towards the police.
An unexpected development took place during the heated exchange. The assailant was wounded in the forearm by gunfire from the officers. Faced with the escalating situation, he eventually obeyed police instructions to throw his firearms out of the window.
After the conflict reached its violent apex, the defendant surrendered and was promptly taken into custody. Post-arrest, the crime scene unveiled a trove of weaponry and ammunition. Firearms found by the officers both inside and outside the home included numerous 9mm cartridges and bullet casings.
The victim was quickly transferred to a nearby hospital for medical attention. She was treated for multiple fractures, necessitating several surgical procedures to mend her scars with plates and screws in her left knee.
The court trial was a lengthy process beginning with initial statements on November 14, subsequently reaching a conclusion on December 11 and 12. The jury took two days of deliberate discussions to finalize their decision, eventually convicting the defendant on several counts including attempted murder, assault, kidnapping, attempted aggravated assault on a police officer, and possession of a weapon. Awaiting his fate at the court on January 24, 2025, the convicted man faces up to 80 years of incarceration. The defendant’s egregious actions of stealing his wife’s firearms, endangering her life, and engaging in a gunfight with responding law enforcement officers were all powerfully countered by Officer Mosquera’s bravery and resilience.
