A resident of Boonville, who also stands registered on the sex offenders list, has confessed to the allegation of a failed attempt to entice three children into his car in Lewis County. This unfortunate event unfolded during the previous week and he was subsequently arrested. The Lewis County District Attorney’s Office has notified that Dwayne E. Kirk appeared in the Town of West Turin Justice Court and admitted his guilt to the offenses which were characterized as misdemeanor stalking.
In reciprocation to his admission, the court delivered a sentence of 89 days in jail. The court also passed protective orders for all three children who were victims of the event. The legal proceedings took place on Wednesday evening and left no room for questioning the charges that had been levied against Kirk.
Once the court session concluded and the judgment delivered, Kirk was taken into custody by deputies and sent off to prison right away for the commencement of his sentence. According to the information shared by the District Attorney’s office, the justice served was swift and immediate, reflecting the gravity of the crime.
The seriousness with which the case was treated within the local law enforcement and by the judicial system was succinctly expressed by the Chief Assistant District Attorney of Lewis County. They said that from the initial stages, the case was dealt with the utmost gravity and that no stones were left unturned for ensuring justice. They further emphasized that the charges and the heavy penalty rested on solid and well-documented evidence, and the nature of the offenses.
Adding to this, they stated that the possibility of any conversation around a plea deal that could lighten the charges was not an option in this case. The avenue of such a plea deal was completely closed off given the remarkable severity of the committed offenses.
This stern stance is backed by the additive that under New York state laws, the most extreme sentence that they could have appealed to the court for, in this particular situation, would have been a mere extra day in prison, making it a total of 90 days of incarceration. This is a reflection of the seriousness with which the incident was treated at every stage of preparation for the trial, during the trial itself, and in the delivery of the verdict.
