Iowa Sues To Defund County That Pledged To ‘Interrupt’ ICE Raids

Iowa Attorney General Brenna Bird is taking a firm stand against local resistance to federal immigration enforcement. On March 26, Bird filed a lawsuit against Winneshiek County Sheriff Dan Marx after he publicly pledged to “block, interfere, and interrupt” ICE raids—raising serious concerns about local law enforcement actively working against immigration laws.

Sheriff Marx drew attention with a now-deleted Facebook post in which he expressed skepticism toward federal immigration enforcement actions. He suggested his office would evaluate and potentially obstruct ICE operations it deemed unconstitutional, particularly criticizing the use of detainer requests—administrative holds ICE uses to take custody of individuals suspected of being in the country illegally.

Marx’s statements did not go unnoticed by Iowa’s top law enforcement official. Attorney General Bird responded swiftly, arguing that Marx’s public stance directly violates a 2018 state law that prohibits Iowa counties and cities from enacting or enforcing sanctuary policies or otherwise limiting cooperation with federal immigration authorities. The law also includes a strict penalty: loss of state funding for any jurisdiction found in violation.

Bird said the sheriff was given the opportunity to retract his comments and avoid legal consequences but refused. As a result, the state is now moving forward with legal action to compel compliance and ensure that Iowa’s immigration enforcement policies are upheld.

“Sheriff Marx’s statements are not only dangerous—they’re illegal,” Bird stated. “No law enforcement officer in Iowa gets to decide which laws to follow or ignore, especially when it comes to protecting our communities from illegal immigration and criminal activity.”

While Marx did remove the original post, he has doubled down on his broader position. In a follow-up statement, he claimed that his office would continue to uphold constitutional rights while complying with state and federal laws. But Bird’s office argues that selectively choosing which ICE actions to support undermines the very laws that local law enforcement is sworn to uphold.

The legal battle is shaping up to be a major test case in the ongoing national clash between state-led immigration enforcement and the defiance of left-leaning local officials. At a time when illegal immigration and criminal alien activity continue to surge across the country, Attorney General Bird’s action sends a clear message: Iowa will not tolerate sanctuary-style behavior, especially from those entrusted with enforcing the law.

As the lawsuit proceeds, it could set a critical precedent not just for Iowa but for other states confronting similar pushback from activist sheriffs and local politicians.
