International Trade Court Examines Presidential Constitutional Violations

Accusations of constitutional violations by the president are being examined by the Court of International Trade, who are considering implementing an initial restraining order prior to this month’s end. The trade disputes initiated by President Donald Trump could be halted abruptly in the absence of concessions from myriad trading nations. The onus lies on the U.S. Court of International Trade, not well-known yet integral, a New York-grounded federal court which is responsible for cases pertaining to customs and trade law.

The court currently has an ongoing lawsuit on their table, which is contemplating the validity of President Trump’s utilization of the 1977 International Emergency Economic Powers Act to introduce a wave of new tariffs in the previous month. Following this, he put a freeze on the highest ones applicable on approximately 60 trading allies for a quarter of a year. Should the plaintiffs receive the court’s approval for a preliminary injunction, the repercussion it could have on the trade deliberations, presently being rushed by the Trump administration with a multitude of nations, can be enormous.

These new regulations vouched for by Trump comprise a basic 10 percent tariff on imports from across the globe. This is compounded by added taxes peaking at 50 percent for a series of trade allies (a measure which currently stands suspended) along with an astronomical tariff amounting to 145% on goods from China. As announced recently by the administration, the colossal tariff on China is under plans to be decreased to a significant 30 percent.

Trump’s key financial representatives and he himself have offered a justification for these tax duties citing that the steeply escalating trade shortage with other nations globally presents ‘a national crisis imperiling our security and the very essence of our existence.’
