The Department of Homeland Security confirmed Sunday that one of the suspects involved in the shooting of a U.S. Customs and Border Protection officer in New York City was an illegal alien who had previously been ordered deported — but was released into the country under the Biden administration.

The off-duty federal officer was shot late Saturday night in an attempted robbery at Fort Washington Park in Manhattan. According to authorities, the 42-year-old officer was struck in the face and arm during an exchange of gunfire with the suspects. He remains hospitalized in stable condition.
“One of the alleged perpetrators was an illegal alien with prior arrests for felony 2nd and 3rd degree assault and an order of deportation,” DHS posted on X. “This was an attempted robbery that resulted in the shooting of a @CBP officer. The suspect had no legal right to be in the United States.”
DHS officials identified the suspect as Miguel Francisco Mora Nunez, a Dominican national who illegally crossed the border near San Luis, Arizona in April 2023. Despite an active warrant for kidnapping in Massachusetts and a 2003 deportation order, Mora Nunez was released into the country.
“This is what happens when the law is ignored,” said Tricia McLaughlin, DHS Assistant Secretary for Public Affairs. “This individual should have never been in the United States — let alone on the streets of New York.”
New York City police are leading the investigation, and one suspect is already in custody. DHS released surveillance footage showing two individuals approaching the officer on a motorcycle. One of them dismounted and opened fire during the ambush before both fled the scene.

The incident is fueling renewed outrage from immigration enforcement advocates and members of Congress, who argue the Biden administration’s border policies are placing American lives in danger by allowing dangerous criminals to remain in the country despite prior deportation orders.
Republicans are demanding answers and accountability as the nation grapples with the consequences of what they say is a deliberate policy of catch-and-release for illegal aliens with criminal records.
