Kyleigh Thurman, a 36-year-old victim of this disturbing situation, fought back bravely only to lose part of her reproductive system and was dismissed without assistance by her local emergency services for her perilous ectopic pregnancy. This is a damning revelation of the state of healthcare provided to the state’s women, with the authorities failing at effectively overseeing the hospitals that deny women necessary emergency abortions.
In spite of the clear message from the federal government’s investigation – that ectopic pregnancies must be treated – Thurman’s story highlights the worrying insensitivity in Texas, one of the states with the most stringent abortion laws in the country. ‘The onus of this professional negligence is not solely on the hospital, it’s also on the powers that set these precedents,’ said Thurman, echoing the concerns of many women in the state.
This serious void in healthcare services is sadly not exclusive to Texas, but is ubiquitous across the country. Extreme cases wherein women are left helpless during medical emergencies are alarmingly on the rise, all due to hastily passed abortion restrictions following a 2022 ruling from the U.S. Supreme Court. With the Texas law still binding, requiring doctors to deliver stabilizing treatment, Thurman did manage to hold her local emergency room accountable for their negligence. The Genesis of this ordeal took place at Ascension Seton Williamson located in Round Rock, Texas, back in February 2023, where Thurman first sought help for her situation shortly after Texas implemented its harsh abortion ban.
Upon visiting the emergency room, it became evident that Thurman was grappling with a severe ectopic pregnancy that was going unnoticed. The pregnancy was undetected in the uterus and present elsewhere in the reproductive system, a clear sign of an ectopic pregnancy. Though these are devastating indicators, Thurman’s predicament was sidelined.
Under such circumstances, ignoring the signs of an ectopic pregnancy can lead to rupture, causing organ impairment, severe blood loss or in worst-case scenarios, death. However, ignoring such irrefutable signs, the hospital shamefully handed Thurman an insubstantial pamphlet on miscarriage – a mockery of her first-life pregnancy, playing down the gravity of her predicament, and she was sent back home.
Thurman’s unfortunate situation took a turn for the worse when she revisited the hospital three days later, still bleeding, only to hear that the time for crucial medical intervention had passed. An emergency surgery was performed, resulting in the removal of parts of her reproductive system. The lack of a basic medical screening exam, including an assessment with an OB-GYN, starkly stood out as an illustration of the hospital’s defiance of the law.
The hospital’s egregious offence did not lie in merely violating the federal Emergency Medical Treatment and Labor Act, which mandates emergency rooms to extend stabilizing treatment to all patients, but in their apathy towards Thurman. The report from the investigation underscored this, clearly pointing out that Thurman was left untreated, contradicting the law, and was placed in a situation where her health and wellbeing were teetering.
Doctors and legal experts alike have expressed their concerns with restrictive abortion laws that dissuade emergency services from performing medically necessary abortions on nonviable pregnancies that threaten women’s lives. ‘We continually witness patients enduring miscarriages being denied the care they desperately need, we see life-threatening pregnancies being perversely prolonged,’ conveyed an attorney from the Center for Reproductive Rights.
While the CMS proclaims that the law will still be enforced, including identified emergency conditions threatening the health of a pregnant woman or her unborn child, these hollow reassurances decidedly lack the necessary action to back them up.
