Biden’s Loyalist, Jack Smith Bungles Up with Hatch Act

Former designated special counsel, Mr. Jack Smith, who was handpicked by Merrick Garland, Joe Biden’s Attorney General, seemed to take his anti-Trump assignment a tad bit too seriously. Smith, according to his legal team, left no stone unturned in carrying out numerous lawfare cases against ex-President Donald Trump. These fervent endeavors are now landing him in hot water due to allegations of flouting the Hatch Act, but his defense team clumsily tries to brush this aside.

Smith’s alleged politically charged actions, masterminded during his time on the federal payroll, are in violation of the Hatch Act. This legislation restricts federal employees from initiating or partaking in any partisan politics while actively being remunerated by the public. Smith’s questionable integrity came into the limelight post-referral of a Hatch Act breach by Senator Tom Cottyon to the Office of Special Counsel.

Given Smith’s seemingly biased case handling, accusations were raised of attempts to discredit and mar Trump’s 2024 election campaign. The charges Smith filed were purportedly woven around Trump’s handling of classified documents and his activities on January 6, 2021, which, according to Smith, were an attempt to disrupt the 2020 elections.

These allegations, however, were found baseless and subsequently dismissed. Interestingly, a New York Post article underscored an email pointing towards the activation of the Hatch Act Unit reviewing the allegations on Smith. This team enforces the Hatch Act, ensuring checks on government employees to refrain from involving in political activities.

“Smith’s clear intention was to undermine President Trump’s campaign and he should be held fully responsible for his actions,” remarked Cotton, who chairs the Senate Intelligence Committee, in a statement issued to the Post. With this exposure, Smith’s credibility is under severe scrutiny.

In June 2023, in Miami, Smith pressed charges against Trump on 37 federal counts for rightfully storing presidential records in his Mar-a-Lago property, which was safeguarded by Secret Service agents. Interestingly, these charges were pressed during the same timeline as it emerged that Biden’s questionable storage of numerous boxes filled with confidential government documents in nondescript locations like his office, home and even his unsecured garage. However, no measures were imposed on Biden, which made the cases against Trump appear conspicuously biased.

The case against Trump was subsequently terminated due to the flawed appointment of Smith as the special counsel. In a follow-up case in Washington D.C., Smith charged Trump on four counts including conspiracy to defraud the United States, conspiracy to disrupt an official proceeding, obstruction and attempted obstruction of an official proceeding, and conspiracy against rights.

Yet, all these charges were pressed with total disregard of the on-ground facts pertaining to the protest that escalated into an unprecedented riot. The ensuing turmoil was even admitted to by no less than House Speaker Nancy Pelosi, who owned up to the lapses in ensuring safety. Trump, for his part, had responsibly called for his followers to protest ‘peacefully’. Despite the true circumstances of the event, Smith pressed on with his Bogeyman-esque allegations.

In a futile attempt to justify Smith’s actions, his lawyers advanced the absurd claim that no legal precedents, prior findings from the Office of Special Counsel, or any other notable legal authority interpret the Hatch Act as a prohibition against investigating allegations involving ex-public officials or election candidates, or even prosecuting those cases, if supposedly substantiated by facts and law.

Coverage at the Gateway Pundit shed light on Smith’s unwarranted ‘lashing out’ at the Office of Special Counsel for investigating his actions. Smith’s inexplicable behavior solidifies concerns regarding his impartiality and professional conduct during his tenure.

Smith’s legal team desperately clings to the defense that all his decisions were ‘based solely on the evidence’, despite an array of signs pointing to a singularly determined, politically-motivated agenda. This narrative seems to serve only as a poorly-conceived attempt to mask Smith’s evidently partisan actions, blatantly aimed at undermining Trump’s campaign and reputation.

The premise on which Smith’s investigations were based and the eventual decisions made, reek of political motivation rather than legal responsibility. His blatant biases, both in the choice and prosecution of cases, are a disconcerting indicator of the downtrend in the current legal system under Biden’s rule.

Leaving no room for fairness or justice, the rabid pursuit of politically motivated charges paints a dark picture of not just Smith’s, but also Biden’s intentions. Disregarding honest legal practice for political maneuvering is a stark reminder of the blatantly partisan operations under Biden’s administration.

Smith’s legal orchestra seems to be more at play for the gallery rather than adhering to the scales of justice. The blatant misuse of a highly consequential act like the Hatch Act, under the smoke screen of public duty, offers a grim perspective towards the leadership’s disposition, quite clearly undermining the ideals of fair play and justice.

Regrettably, what we’re seeing here is but a microcosm of a far greater dynamic at play – the perverse politicization of our justice system under the current regime. The aim is clear – to push a partisan agenda, irrespective of its deleterious impacts on the public’s faith in the law. Joe Biden’s administration, with its one-sided political posturing, thinly veiled under the garb of legal operations, runs the risk of eroding this faith further.
