This ruling indicates that President Trump’s application of the 1798 Alien Enemies Act to combat the Tren de Aragua gang from Venezuela went beyond the boundaries set by the act. Two judges voiced their opinion that the gang’s behavior did not reach the level of national conflict that the law originally intended to target. Clearly, resolving this case will depend on interpreting immigration laws in light of contemporary challenges.
Alan Dershowitz has highlighted the intricacies involved in the case by stating, ‘It’s a close call. Depending on your perspective, you could see this statute as encompassing a massive influx into the U.S. orchestrated by another nation.’ He added, ‘The decision was split two to one.’

The gang Tren de Aragua, has roots dating back to a Venezuelan prison in 2013 and has cultivated into a ferocious global organized crime syndicate. Today, they’ve assembled a strength of nearly 5,000 members operating over various international borders, boasting an impressive yet disturbing range.
Tren de Aragua’s influence has even extended to the U.S. It has a confirmed presence in at least 15 states, which led to President Trump labeling it and other significant Latin American factions as international terrorist organizations via an executive order.
Possibly 8 million Venezuelans have absconded from their country, fleeing the oppressive governance of President Nicolas Maduro. A significant portion of these Venezuelans attempted to infiltrate the U.S. borders during the Biden administration, thus testing the security measures in place.
Several of these individuals managed to gain entry illegally, while others utilized Joe Biden’s scheme set up for Cubans, Haitians, Nicaraguans, and Venezuelans. Unfortunately, this program has been manipulated by entities who were subsequently associated with the Tren de Aragua gang, a fact reflected in arrest records and data from Customs and Border Protection.
Clearly, Biden’s program provided a loophole, a sneaky passage that was promptly exploited. By creating avenues for potential gang members to infiltrate the nation, the parole program inadvertently served as an accomplice to crime syndicates such as Tren de Aragua.
