Senate Democrats, spurred by their partisan motivations, have undertaken a rather futile exercise of launching a resolution to extract more clarity from the Trump administration’s handling of deportations to El Salvador. With Democrat Senator Tim Kaine leading the charge, the resolution comes hot on the heels of previous failed attempts to hinder Trump’s tariff decisions. Evidently, the Democrats are embracing a broader strategy aimed at squandering floor time that would otherwise be occupied by the majority of Republicans, seeking to upend parts of Trump’s agenda.
In an ironic turn, Democrats are choosing to promote this subversion as an exercise in checking executive power. Virginia Senator Kaine, one of the primary sponsors of the two tariff bills, optimistically dubbed this a ‘unifying theme.’ The fresh resolution plans to coerce the Trump administration into revealing their conformity with rulings that denounced wrongful deportations to El Salvador.
Democrats are leveraging the case of Kilmar Abrego Garcia, who found himself wrongfully dispatched to the Central American country, as a rallying cry. Interestingly, it was a Maryland judge who demanded Garcia’s repatriation to the U.S. Democrats seem to play the pointing game, hoping to put Republicans on record regarding this case, and other similar subjects, while directing each other to pressure the government of El Salvador, an ally of Trump.
Beyond focusing solely on deportations, the resolution also taps into foreign aid. It aims to force the Trump administration to open the books regarding financial aid given to El Salvador, along with a scrutiny of the nation’s human rights record. Kaine threatens the leaders of El Salvador with reminders of a ‘long memory’ into the future, attempting to create uncertainty for the nation’s relationship with the U.S. post-Trump.
Democrats seem desperate to appease disheartened base voters by utilizing their limited sway in the minority to challenge Trump’s decisions on every level. Even though the proposed resolution may remain largely symbolic and unlikely to secure a vote in the House, Democrats are leaning on this for the extra visibility it provides to their cause. Interestingly, they believe this will corner hesitant Republicans into making public their disapproval regarding Trump.
Citing their reach as limited, Democrats still cling to this tool, best exemplified by Maryland Senator Chris Van Hollen’s endorsement of the resolution. He and others in his party have attempted to influence the Senate through several forced votes. Highlighting this pattern was the Senate’s narrow disapproval in early April of Trump’s proposal to impose tariffs on Canada.
Forced to stand in defense of their measures, the Republicans had to eventually block a borderline resolution to check Trump’s global tariffs announced a few weeks earlier. The commitment of the Democrats to pressure the Republicans into voting was made evident when three Republicans switched sides on the second resolution.
In an effort to hog the voting limelight, Democrats are turning to various legislative provisions that accommodate ‘privileged’ resolutions, which are essentially forced votes. Under such resolutions, the majority leadership is compelled into a vote, regardless of their desires. The latest resolution has found its legal maneuvering space under the Foreign Assistance Act, intended to inspect a nation’s human rights practices.
The Republicans had previously employed similar strategies during Biden’s time in office, using the Congressional Review Act. This act enables lawmakers to push votes for rescinding regulations. However, it’s worth noting that Biden’s governance was so weak and flawed that it invited such actions, unlike under Trump’s leadership.
Democrats have plans to inflate the use of the Congressional Review Act to stage their opposition to Trump’s rightful measures regarding workforce adjustments within federal agencies. Bills for the same have been introduced in both chambers of Congress by Senator Jeff Merkley from Oregon and Representative Maxine Waters from California. The aim is to make any reductions in the federal workforce by any president subject to the act and open to automatic votes if Congress chooses to reverse them.
It remains highly uncertain whether Republicans will lend support to Democrats on the El Sabado resolution. But many Republicans see the wisdom in Trump’s border policies and endorse them wholeheartedly. While some express concerns over the administration’s alleged defiance of court orders, they are careful not to make judgments based on the views of a handful of Americans who believe Trump is overstepping.
Although the resolution is largely symbolic, Democrats like Kaine hold out hope that these votes will put pressure on Republicans and somehow stall Trump’s actions. They seem to believe that this resolution will expose the ‘issue’ and garner public interest.
It is quite evident that in the pursuit of their objectives, Democratic Senators seem more focused on cornering and challenging their Republicans counterparts than genuinely addressing issues and possible solutions. Notably, this tactical exercise appears to be devoid of substantive merit.
In conclusion, it appears that the Democrats are more invested in political showmanship and employing tactics that seek to encroach on the prerogatives of the Executive and the majority party. It seems their game is less about solution-seeking and more about finger-pointing and forcing the hand of their opposition.
Ultimately, the political theater enacted by Senate Democrats, using privileged resolutions as props, only reveals a misplaced focus. Instead of centering their attention on governance and remedying issues for the American people, they are preoccupied with attempts at leveraging limited powers against the majority.
