Attorney General Pam Bondi issued a strong warning Monday to former FBI Director James Comey and New York Attorney General Letitia James, promising that the Department of Justice will appeal a federal judge’s dismissal of their indictments.
“We’ll be taking all available legal action, including an immediate appeal, to hold Letitia James and James Comey accountable for their unlawful conduct,” Bondi said during a press briefing, according to Fox News. “I’m not worried about someone who has been charged with a very serious crime. His alleged actions were a betrayal of public trust.”
Bondi’s remarks come after U.S. District Judge Cameron McGowan Currie dismissed the charges against both Democrats on procedural grounds. Currie ruled that Lindsey Halligan, the Trump-appointed interim U.S. attorney who secured the indictments, was not lawfully serving in that capacity at the time.
President Trump had appointed Halligan to replace former U.S. Attorney Erik Siebert, who had overseen investigations into Comey and James but resigned before filing charges. Halligan, formerly a member of Trump’s legal team, was later named a special U.S. attorney to allow her to continue representing the government in court.
“We have made Lindsey Halligan a special U.S. attorney so she is in court, she can fight in court just like she was, and we believe we will be successful on appeal,” Bondi said.
She also defended Halligan’s credentials and criticized those questioning her appointment. “I talked to all of our U.S. attorneys, the majority of them around the country, and Lindsey Halligan is an excellent U.S. attorney. Shame on them for not wanting her in office.”
Comey was indicted in September on charges of making false statements and obstructing a congressional proceeding. The charges were tied to his 2020 testimony before Congress about the FBI’s handling of its Trump-Russia investigation.
Letitia James was indicted in October for allegedly lying about her primary residence in order to obtain a more favorable mortgage for a house in Virginia while serving as New York attorney general — a position that requires legal residency in the state of New York. Prosecutors say the home was actually occupied by a relative of James, not her.
James rose to prominence by aggressively targeting Trump in civil court, having campaigned on a platform of opposing the former president. Critics have long argued her actions were driven more by politics than the law.
Bondi’s vow to appeal signals that the DOJ under Trump’s leadership is not backing down from prosecuting high-profile Democrats despite legal roadblocks. Both Comey and James deny the charges.
