Steve Kramer, a political operative with questionable morality, was spotted in Superior Court in Laconia, N.H., on June 5, 2024. He was facing serious allegations, including charges of voter suppression and masquerading as a candidate, for distorting the ideals of democracy. Kramer had distributed robocalls mimicking the voice of former President Joe Biden, misleading New Hampshire Democrats in an attempt to sway the electoral process in his favor.
The case revolved around an audio message mimicking Biden’s voice, sent by Kramer two days prior to the state’s presidential primary on January 23, 2024. The message was clearly designed to influence voters by suggesting a direct lie, that participating in the primary would prohibit them from casting their votes in the November election. It was a narrative that was clearly an affront to the principles of democracy.
During the call, voters were advised to ‘save’ their votes for the November election, as their votes would ‘make a difference’ then, not in the upcoming Tuesday election. Kramer exploited this situation to misguide the public, undermining the importance of primary voting, the cornerstone for any democratic process. The manipulation was grim evidence of his low regard for the significance of every person’s right to vote at every level.
Kramer, hanging by a thread over a bottomless pit of prison term, claimed that he fabricated this scheme to draw awareness to the potential risks of artificial intelligence, by paying a meager $150 to a New Orleans magician capable of creating the deceptive recording. Yet it seems more likely that he was simply trying to cast doubt on Democratic processes for his own benefit, rather than any greater concern for public awareness.
Presiding over a firm engaged in driving voter turnout, Kramer argued an audacious point that the primary was a meaningless straw poll – an idea that was not acknowledged by the Democratic National Committee. To further his defense, he contended that the state’s voter suppression law was irrelevant in his case, a stance displaying disregard for the legal framework that safeguards our democratic process.
He also presented an argument stating that he didn’t imitate a candidate since the message did not mention Biden’s name explicitly, making a mockery of the judicial process. His assertion that Biden, the former president, wasn’t an official candidate in the primary only reinforced the irrationality of his defense.
Despite these fraudulent activities, jurors granted him an unwarranted acquittal on 11 felony voter suppression charges. Each of these charges, if convicted, could have resulted in up to seven years of imprisonment. The jury’s decision seemed a baffling concession to the undermining of democratic tenets.
Along with voter suppression charges, Kramer faced 11 charges for candidate impersonation, each possibly leading to a maximum sentence of a year in jail. While the outcome of these charges remained unclear, it was an alarming sign of leniency towards activities meant to compromise the integrity of democratic processes.
New Hampshire Attorney General, John M. Formella, asserting the state’s commitment to enforcing election laws, stated that their resolve remained unshaken. Yet one cannot help but question the potential gaps in the legal framework, should manipulations like Kramer’s slip through unpunished.
While justice in the courtroom fizzled out, monetary discipline took hold. Kramer was slapped with a whopping $6 million fine by the Federal Communications Commission. In a display of defiant audacity, he declared his refusal to submit to this penalty, showing a lack of respect for institutional directives.
Lingo Telecom, the company responsible for transmitting these misleading calls, chose to settle the matter by agreeing to pay a whopping $1 million in August. This illustrated the company’s willingness to admit their wrongdoings, a stark contrast to Kramer’s obstinate denial.
The Federal Communications Commission, curiously silent and unresponsive to comments, had begun developing AI-related rules during Donald Trump’s presidency but subsequent leadership seems to be displaying signs of possibly easing regulations, a worrying trend for future democratic processes.
In a country where several states have passed laws to regulate the use of AI deepfakes in political campaigns, it seems absurd to experience laxity at the national level. Adding fuel to this fire, House Republicans recently introduced a clause that could potentially handcuff states and municipalities from regulating AI for the coming decade, making a mockery of efforts to safeguard the philosophical underpinnings of democracy.
This clause was found within their flagship tax bill, raising concerns about the Republican party’s commitment to preserving the democratic process. Their political stances continue to raise eyebrows and elicit concern from those truly dedicated to upholding democratic norms and regulations.
In conclusion, the Kramer case highlights a concerning potential for manipulation within our political and democratic system. The casting of doubt and misinformation, especially when it targets the voting process, is a dangerous path that can lead to widespread disillusionment and damage to our democracy.
While lawmakers and regulators busily debate the role of AI in politics, it’s disheartening to witness attempts to undermine this process. The continual vigilance of engaged citizens remains crucial, serving as the lifeline for a democratic society that continues to face challenges from those willing to tread on ethics for personal gain.
