The Trump government faced a lawsuit on Sunday due to its initiative to assign National Guardsmen to Portland, Oregon. Both the state of Oregon and the city of Portland are scrutinizing the Trump administration’s strategy through legal means, attempting to stop its decision to deploy National Guard soldiers to the so-called City of Roses. This legal action, filed on Sunday in the U.S. District Court of the District of Oregon, Portland Division, piles onto the growing number of challenges against President Donald Trump’s decision to dispatch military resources to American urban centers.
The lawsuit was instigated after Trump’s public announcement on Saturday, in which he informed the Secretary of Defense to allocate ‘all necessary troops’ for the protection of a ‘war-torn’ Portland. He further permitted them to use ‘full force,’ suggesting that this measure could be taken if the situation demanded it. The state and the city, under Democratic leadership, revealed that the Secretary of Defense had begun the process of federalizing 200 members of the Oregon National Guard, in what they believe to be a violation of the state’s sovereign authority to supervise its own legal enforcement and National Guard resources.
According to the lawsuit, the accused, being the Trump administration, are imposing federal dominion not founded on credible information – an act that not only disregards the promotion of public safety but also endangers it. It suggests that such an aggressive deployment of troops could potentially intensify existing tensions and provoke fresh unrest, leading to an increase in the law enforcement resources that the Plaintiffs would have to expend to manage the inevitable repercussions of the Defendants’ actions.
The reason for this military deployment to Portland by Trump was attributed to the longstanding protests near an Immigration and Customs Enforcement facility. However, both the city and state contend that deploying the National Guard equates to an excessive measure, given that less than 30 arrests have been made during the protests period, with no arrests recorded since mid-June.
The lawsuit undermines Trump’s depiction of Portland as a ‘war-torn’ city ‘under siege’ from ‘domestic terrorists,’ dismissing it as a greatly exaggerated, unfounded pretext. At a press briefing held on Saturday, the Governor of Oregon communicated her conviction that they are fully capable of managing their own public safety concerns.
She asserted emphatically that the state was not experiencing any insurrection, nor was there any looming threat to national security that would necessitate the presence of military troops in major cities. The Governor further stressed that military service members ought to be utilized for real crises. She continued to defend the Oregon National Guard, stating that their role is to protect Oregon’s citizens, and while they would continue to do that every day, the deployment of these troops within the city was unnecessary.
According to the lawsuit, the Trump administration is infringing on a specific federal law that restricts the President’s control over National Guardsmen only to situations when the United States faces danger from foreign invaders, internal rebellion or when routine legal enforcement becomes unfeasible.
Furthermore, the lawsuit alleges that Trump’s administration is flouting the 10th Amendment of the Constitution. This amendment reinforces that police powers are primarily entitled to the states. The lawsuit argues that by deploying the National Guard, the administration is directly bypassing state authority.
The Trump administration’s decision to deploy National Guardsmen extends beyond Portland, impacting multiple cities, including Memphis, Los Angeles, and the national capital, Washington, D.C. This wide-ranging deployment has not been received without contention, sparking a series of lawsuits across the affected cities.
Earlier in the month, a federal judge sided against the Trump administration’s motion to deploy troops in Los Angeles. However, the impact of this ruling was temporarily halted due to an ongoing appeal. This incident, among others, depicts the tense nationwide controversy surrounding the use of military forces in domestic urban settings.
