Mitch McConnell, the spearhead of Senate Republicans, took it upon himself to critique Biden’s suggestions of imposing term limits on Supreme Court justices, quipping that such a radical idea will be nothing short of ‘unconstitutional’ and certain to be rejected by Congress without consideration. The irony doesn’t escape anyone that President Biden, who once presided over the Senate Judiciary Committee, would actively undermine the underlying principles of justice with such proposals.
No one can view President Biden’s recommendation, which notably includes allowing presidents to assign justices every two years and capping their service period to 18 years, as anything less than a colossal disappointment. McConnell, being one of the fiercest champions of the Supreme Court system in the Senate, found the disapproving sentiment shared by many.
Having been a chairman of the Judiciary Committee himself, Biden is well-aware of the limitations and boundaries within the Constitution. McConnell said it confidently and for all to hear that Biden is knowingly suggesting unconstitutional adjustments concerning the tenure of Supreme Court justices, who are rightfully appointed for life as stipulated by the Constitution.
This move by Biden reveals Democrat’s desperation in their endless attacks on the Supreme Court. Apparently, they’re discontented by the current composition of the court and some decisions that didn’t go their way.
Mitch McConnell emphasized that the correct and ethical way to alter Supreme Court’s makeup is through the proper democratic channels – by winning the presidency and the Senate, subsequently appointing individuals of one’s preference, not by grotesquely dismantling the Supreme Court. He ominously concluded the statement asserting such level of disruption is simply not acceptable.
As menacingly as the proposal from Biden looks, McConnell expressed confidence that it is going to be dismissed without any hesitation in Congress. ‘I know he knows better,’ Mitch McConnell emphasized, perfectly responding to Biden’s failing attempt to undermine the judicial system.
Furthermore, Biden’s ambition doesn’t stop at making drastic changes at the top levels of Judiciary. He also seeks constitutional amendments that mandate that former presidents should not enjoy immunity against crimes committed during their tenure and proposed a legally binding code of conduct for Supreme Court justices. Yet, the absurdity of the proposals leaves much room for criticism.
In an attempt to validate his misguided ideas, Biden referred to the Supreme Court’s recent decision of granting extensive immunity to presidents against prosecutions for acts committed in an official capacity and the consequential verdict to overturn Roe v. Wade along with the right to abortion, all in a op-ed for the Washington Post. The fact that he had to take his case to a newspaper column instead of an official platform reflects the shaky ground his ideas stand on.
Emphasizing his long-standing service as a senator and his role as the chair and ranking member of the Judiciary Committee, Biden exhibited misplaced respect for institutions, and separation of powers. His words fall on deaf ears when actions clearly demonstrate otherwise.
His audacious claim that the current circumstances were ‘not normal’ and that they were denting the public’s faith in court decisions, especially those concerning personal freedoms, seems like a desperate grab to justify his damaging proposals.
On the other side of the aisle, in a classic display of ambiguity, Senate Majority Leader Chuck Schumer refrained from committing whether he would endorse Biden’s contentious suggestions to the Senate, yet he was quick to label the court as being stuck in a ‘quagmire’ because of controversial decisions and allegations of misconduct by conservative justices Clarence Thomas and Samuel Alito.
Schumer’s criticisms reveal a surprising bias as he attacked the Supreme Court, a revered institution, labeling it as a ‘true quagmire,’ both ethically and substantively. It appeared as if Schumer was more interested in promoting a biased agenda than in upholding justice.
Schumer’s audacious comments found him accusing wealthy, hard-right factions of corrupting the Supreme Court by bestowing gifts amounting to millions of dollars. His accusations not only seemed baseless but also had the smell of a smear campaign designed to ruin the reputations of individuals and institutions.
In Schumer’s eyes, the court was busy rescinding people’s rights, a reference subtly hinting at the decision to overturn the right to abortion. Amid such baseless allegations, the claim that the Supreme Court needs ‘a lot of changes’ and that they are ‘looking at a whole lot of things’ feels more like a veiled threat than a constructive suggestion.
