Bill Melugin on New DHS Report: Biden Officials Do Not Track Illegal Aliens Who Enter the US without IDs – Not Sure Who They Are – But Allow Them to Travel on Planes

NEW: In a new, heavily redacted DHS Inspector General report, the IG finds that “CBP, ICE, and TSA did not fully assess risks associated w/ releasing noncitizens without ID into the U.S. and allowing them to travel on domestic flights.”

Key finding: “Under current processes, CBP and ICE cannot ensure they are keeping high-risk noncitizens without identification from entering the country. Additionally, TSA cannot ensure its vetting and screening procedures prevent high-risk noncitizens who may pose a threat to the flying public from boarding domestic flights.”

The IG says that according to federal law, “noncitizens without ID are not admissible into the country and “shall be detained,” but that CBP and ICE are permitted to release noncitizens into the U.S. based on various circumstances.

The report says CBP and ICE accept “self reported biographical information, which they use to give migrants immigration forms, who are then able to get on domestic flights, even if they don’t have ID.

The IG says he asked DHS for data on the number of noncitizens who did not have ID and were released into the U.S. between fiscal years 2021-2023, but CBP and ICE were unable to provide the data because they don’t log whether a noncitizen had ID in their databases. The OIG adds that “immigration officers we interviewed acknowledged the risks of allowing noncitizens without ID into the country.”

Judge Finds Newsom’s New California Deepfake Ban Unconstitutional 

A federal court judge issued a preliminary injunction against a two-week-old California law that effectively bans election-related deepfakes.

The law — AB 2839 — allowed any person to sue for damages over AI deepfakes within 120 days of an election and up to 60 days after if the perpetrator’s post resembled a political candidate.
Judge John A. Mendez said artificial intelligence and deepfakes pose significant risks but ruled that the law was “unconstitutional” as it likely violated the First Amendment.

“The Court finds that AB 2839 is also unconstitutional under California’s free speech provision.”

Massie’s letter, signed by ten members of the House Judiciary Committee, follows testimony by the DOG’s Inspector General suggesting that the FBI had confidential human sources (CHSs) on the Capitol Grounds that day and that DOJ may be slow-walking the release of his final report on the matter.
Joining Massie in the letter are Judiciary Committee Chairman Jim Jordan (R-OH) and Reps. Ben Cline (R-VA), Chip Roy (R-TX), Andy Biggs (R-AZ), Victoria Spartz (R-IN), Barry Moore (R-AL), Dan Bishop (R-NC), Harriet Hagman (R-WY), and Matt Gaetz (R-FL).
The presence of federal assets, specifically confidential human sources (CHSs), on Capitol grounds during the events of January 6, 2021 has emerged as a key piece of evidence that undermines the establishment media and federal government’s narrative of the January 6 events at the Capitol. Just blocks away from the Capitol, Trump is being charged in federal court by special counsel Jack Smith with election interference, in part stemming from allegations he somehow orchestrated the events at the Capitol.
Massie’s letter reminds Garland that during his June 4, 2024 testimony, Garland “testified that Inspector General Horowitz is ‘independent’ and ‘the determination of the release of Inspector General reports is up to the Inspector General.’”
“We write to remind you of your commitment,” the letter reads.

In the September 25 hearing, Horowitz confirmed that his draft report would address CHSs. Massie pressed Horowitz on evidence of the number of CHSs operating on the Capitol grounds on January 6.
“Our report will include information in that regard,” but when pressed on the exact number, he replied “I’m not in a position to say that, both because its in draft form, and we have not gone through the classification review, and so I need to be careful.”

The FBI is an agency of DOJ, which ultimately determines what is classified.

Multiple Office of Inspector General audits found a range of failures at DHS and its subagencies, from vetting, to screening to releasing foreign nationals who Republicans say pose a national security threat. Its secretary, Alejandro Mayorkas, was impeached in February by House Republicans for dereliction of duty, including the failures the OIG identified.

“Recent incidents and disasters highlighted the need for situational awareness throughout the Homeland Security Enterprise,” the OIG says, which is why it audited DHS to determine if it was sharing “actionable information on emerging threats with its external partners.”
The OIG found that it wasn’t and DHS partners “did not always use DHS technology to obtain emerging threat information.”

One OIG report found that individuals on the terrorist watchlist were being released into the country because of DHS’ U.S. Custom and Border Protections’ “ineffective practices and processes for resolving inconclusive matches with the Terrorist Watchlist led to multiple mistakes.”

Another OIG report found that DHS didn’t properly vet Afghanistan nationals admitted into the US., including those who were deemed “a risk to national security.”
In another report, the OIG found that CBP and U.S. Immigration and Customs Enforcement were not detaining or removing inadmissibles flying into country, raising national security alarms. Another report found that roughly 200,000 deportation cases were dismissed because DHS failed to file paperwork.
In another, the OIG found that CBP and U.S. Citizenship and Immigration Services vetting of asylum seekers was inadequate, they weren’t fully screening or vetting noncitizens applying for admission into the U.S. and still released them.

 Federal prosecutors requested an indefinite delay Wednesday in scheduling the trial for the man charged in an apparent assassination attempt on former President Donald Trump at his Florida golf course last month, citing a massive amount of evidence they’ve gathered in the 17 days since Ryan Routh’s arrest.

In a filing Wednesday afternoon requesting Florida District Judge Aileen Cannon officially designate Routh’s case as “complex,” prosecutors revealed new details about the scope of evidence they’ve amassed as they try to further gain insight into Routh’s actions leading up to his suspected attempt to kill Trump.

The Islamic Republic definitely has it out for Trump, but it seems this most recent Iranian plot to kill the Republican candidate was hatched by the FBI.
Earlier this month, the DOJ announced it had charged a Pakistani national with ties to Iran in connection to a plot to assassinate a politician or U.S. government official on U.S. soil. According to reports, Trump was the target.
The suspect, Asif Merchant, entered the country in April and was arrested on July 12 as he prepared to leave the country. It appears that Merchant was the Iranian threat the Secret Service was briefed on before the July 13 rally in Butler, PA.
The FBI arranged his entry into the U.S. According to an August Twitter post from Fox correspondent Bill Melugin, Merchant “was admitted into the U.S. via parole for ‘significant public benefit’ when [Customs and Border Patrol] encountered him at the airport in [Texas] in April after he flew in from overseas.” The sponsor of his parole, Melugin reported, “was the FBI’s Dallas office, for ‘security interests.’”
Melugin’s sources told him the FBI had intelligence on Merchant “before he arrived in the U.S. and needed him to physically come into the country to develop the case on him and arrest him, and that if they had arrested him at Customs, they would not have been able to gather evidence and information about his plot.”
But to date there’s little evidence the FBI developed a case based on intelligence collected before Merchant’s entry. Rather, it seems more likely that federal law enforcement imported a terrorist entrapment target for the purpose of fabricating a plot. Former FBI agent turned whistleblower Steve Friend says the Bureau’s playbook is simple: “Identify a vulnerable person. Establish fake friendships with undercover agents and informants. Encourage him to agree to commit a terrorist act he is otherwise incapable of committing. Arrest him.”

Cybersecurity Chief Says Foreign Interference Won’t Significantly Alter US Election Results

Jen Easterly, director of the Cybersecurity and Infrastructure Security Agency (CISA), said that America’s election systems are so secure that foreign adversaries will be unable to manipulate the outcome of the 2024 presidential election in a “material” way.

“Malicious actors, even if they tried, could not have an impact at scale such that there would be a material effect on the outcome of the election,” Easterly told the outlet.
