The ex-president, Donald Trump, has made a public declaration regarding his intention to provide testimony in the ongoing $250 million civil fraud lawsuit brought against him by the Attorney General of New York, Letitia James.
According to a report by Newsmax, former President Donald Trump has expressed his intention to provide testimony “at the appropriate time.” He is included in the witness lists both for his own defense and for the team representing the Attorney General.
“Yes, I will” testify at the trial, Trump told reporters in remarks during the lunch break on day two of the trial Tuesday. “At the appropriate time, I will be,” he added.
“I think it’s going very well,” he continued after being asked to assess the trial thus far.
“There was absolutely no fraud,” Trump said, going on to criticize James as having filed a corrupt and politically motivated case. “They all made money. They’re all happy, 100% happy.”
Trump restated his prior assertion that his accountants consistently appended a disclaimer of “buyer beware” to the conclusion of his financial statements.
“It says, ‘Please, you must understand that you have to do your own due diligence and you have to, above all, do your own research and analysis: Do not rely on anything; do not rely on the financial statements,’” Trump added. “Also, the financial statements are very strong in terms of cash liquidity and everything else.
“This case is a scam. There can’t be fraud when you’ve told institutions to do their own work. This case is a fraud and scam,” he added.
In contrast, Judge Arthur Engoron, who presides over the case, has exhibited a notably adversarial stance towards the former president and his legal counsel.
Engoron issued a warning on Friday, expressing the possibility of incarcerating Trump and imposing substantial monetary penalties on him due to his overt violation of a gag order. This violation pertained to Trump’s refusal to withdraw a website post that launched an attack on court personnel.
“In the current overheated climate, incendiary comments can, and in some cases already have, led to serious physical harm and worse. I will now allow the defendants to explain why this blatant violation of the gag order would not result in serious sanctions, including financial sanctions and/or possibly imprisoning him,” Engoron said.
The ongoing trial overseen by Judge Engoron pertains to allegations of fraud and is classified as a civil case. Consequently, it is unlikely that Trump will be subject to incarceration, but rather may face financial penalties and the potential dissolution of his real estate holdings.
According to a report by the Daily Beast, the judge issued a warning to Trump, indicating that he may face incarceration if he fails to adhere to the requirements.
Christopher Kise, the defense attorney representing Donald Trump, promptly issued an apology, ascribing the occurrence to an inadvertent omission on the part of Trump’s extensive “campaign machinery” in neglecting to remove a webpage that copied the Truth Social post previously erased by Trump.
“There was no intention to evade or circumvent or ignore the order. I assure you that. I just know that this is a very large machine and this is one of the reasons, frankly, I don’t have social media,” Kise said, trying to deflect with some light humor.
“But that’s been taken down. And we don’t have any other… there were no subsequent postings,” Kise added.
“I will take that under advisement, but… Donald Trump is still responsible for the large machine,” Engoron reminded him.
This official reprimand is a consequence of the judge’s prior admonitions to the emotionally unstable individual involved in real estate, cautioning against the recurrence of tactics aimed at intimidating witnesses and defaming judges and prosecutors within the jurisdiction of New York state court.
In order to apprise the legal representatives of President Trump of the gravity of their situation, Engoron dedicated a portion of his time on Friday morning to conduct a comprehensive examination of the events that have transpired thus far. This included addressing the issue of an inaccurate and defamatory tweet that targeted my esteemed primary law clerk on a personal level.
Furthermore, according to sources, he disclosed to the press the events that transpired in his courtroom during their absence.
