The judge, who was appointed by President Obama, who is presiding over the federal election interference case against former President Donald Trump, made a decision on Monday to issue a gag order. This order will restrict Trump from publicly discussing the details of the case.
Background:
The pursuit of a gag order is being undertaken by Jack Smith, special counsel of the Biden Justice Department. Smith has previously contended that President Trump’s tendency to criticize him and other Democratic prosecutors in his four criminal cases is having a detrimental effect on the pool of potential jurors who will determine whether President Trump knowingly incited the riots on January 6th, 2021.
According to POLITICO, Judge Tanya Chutkan of the U.S. District Court will carefully consider arguments from all parties before deciding whether to issue an order to President Trump, instructing him to abstain from making derogatory remarks about potential witnesses, prosecutors, and court personnel.
Trump has already made derogatory yet hilarious remarks about the chief prosecutor, referring to him as “Deranged Jack Smith,” and highlighting his track record of engaging in
what the president perceives as politically motivated investigations targeting elected individuals.
Smith is currently spearheading an independent federal lawsuit against President Trump pertaining to the management and safeguarding of confidential data at Mar-a-Lago.

President Trump, who has asserted that his frequent expressions on Truth Social are shielded by the First Amendment, would encounter his initial encounter with the judicial system in the event that a gag order were to be imposed. Judge Chutkan has previously issued cautionary remarks to President Trump on his statements, implying that she possesses the ability to expedite the trial proceedings in order to mitigate potential bias within the jury pool.
Observers of the court are also engaging in conjecture over the potential actions that Judge Chutkan might undertake, including the possibility of imposing restrictions on President Trump’s internet usage in the event of a breach of the imposed restriction on public statements.

On Sunday Trump blasted Jack Smith and Dems on Truth Social stating:

A Leaking, Crooked and Deranged Prosecutor, Jack Smith, who has a terrible record of failure, is asking a highly partisan Obama appointed Judge, Tanya Chutkan, who should recuse herself based on the horrible things she has said, to silence me, through the use of a powerful GAG ORDER, making it impossible for me to criticize those who are doing the silencing, namely Crooked Joe Biden, and his corrupt and weaponized DOJ & FBI. They want to take away my First Amendment rights, and my ability to both campaign and defend myself. In other words, they want to cheat and interfere in the 2024 Presidential Election. Nothing like this has ever happened in our Country before. It is strictly Banana Republic kind of “stuff.” These political Hacks and Thugs are destroying our Country. Let’s see what happens on Monday in Judge Chutkan’s courtroom. Will America survive, or not? I’ll be campaigning in the Great State of Iowa, where I am leading by 50 Points!!!”
Rep. Marjorie Taylor Greene is at the courthouse and posted:
“I’m here at the Federal courthouse in DC as a member of the Oversight Committee to see if Judge Chutkan is really going to destroy the 1st amendment – free speech rights of former President Trump and leading candidate for President in 2024.”
When word of the gag order reached Trump he posted:
“The TRUMP GAG ORDER that the CORRUPT Biden Administration is trying to obtain is totally Unconstitutional!”

A federal judge on Monday issued a gag order on former President Donald Trump, limiting what he can say about special counsel Jack Smith’s federal prosecution into his alleged attempt to subvert in the 2020 presidential election.
The order restricts Trump’s ability to publicly target court personnel, potential witnesses, or the special counsel and his staff. The order did not impose restrictions on disparaging comments about Washington, DC, – where the jury will take place – or certain comments about the Justice Department at large, both of which the government requested.
“This is not about whether I like the language Mr. Trump uses,” Judge Tanya Chutkan said. “This is about language that presents a danger to the administration of justice.”
“His presidential candidacy does not give him carte blanche to vilify public servants who are simply doing their jobs,” the judge added.
Chutkan noted that any violation of her orders could result in sanctions.
